1. About These Terms
These Terms and Conditions ("Terms") govern the relationship between Somn Studio ("we", "us", "our") and any individual or organisation ("you", "the client") who engages our interior design services or browses our website at somnstuds.cyou. Somn Studio operates from 8 Jalan Ampang Hilir, 55000 Kuala Lumpur, Malaysia.
By submitting an enquiry, entering into a service agreement, or continuing to use our website, you confirm that you have read and accepted these Terms. If any part of these Terms is unclear, we encourage you to contact us at [email protected] before proceeding.
2. Our Services
Somn Studio provides three principal service engagements:
- Introductory Design Dialogue (MYR 440): A structured conversation exploring how you relate to and use your space. Includes a written reflection with design observations, reference imagery, and initial layout thoughts. Suitable for homes and small offices. Delivered within one week of the session.
- Design Narrative & Documentation (MYR 3,200): A comprehensive design service covering spatial layouts, material selections, furniture curation, lighting atmospheres, and detailed 3D views. Includes two rounds of revisions and a contractor-ready specification package. Delivered in 6–10 weeks for residential and commercial projects.
- Execution & Finishing Support (MYR 1,650): Hands-on coordination through the renovation and furnishing phase — procurement management, trade coordination, site reviews, and space styling. Concludes with a formal walk-through. Typically 8–14 weeks duration.
The specific scope of each engagement will be documented in a written brief or proposal agreed upon before work commences. Services not expressly included in the agreed scope may be subject to additional fees, which we will discuss with you in advance.
3. Engagement Process
Our working process follows these stages:
- Enquiry: You contact us through our website or by phone. We will respond within two working days.
- Proposal: We provide a written outline of scope, deliverables, timeline, and fees for your review.
- Agreement: Engagement commences upon your written confirmation and receipt of any deposit specified.
- Delivery: We deliver work according to the agreed timeline, keeping you informed at each stage.
4. Fees and Payment
All fees are quoted in Malaysian Ringgit (MYR) and are inclusive of applicable taxes unless stated otherwise. A deposit of 50% of the total engagement fee is typically required before work begins. The remaining balance is due upon project completion or at milestones set out in the proposal.
Invoices are issued electronically. Payment is due within 14 calendar days of the invoice date unless otherwise agreed in writing. We reserve the right to pause work on an engagement where payment is materially overdue, and will communicate this clearly before doing so.
For the Introductory Design Dialogue, the full fee is payable in advance of the session.
5. Revisions and Changes
The Design Narrative & Documentation service includes two rounds of revisions within the agreed scope. Revision requests that fall substantially outside the original brief, or that are requested after the revision phases have been completed, may be quoted separately.
Any changes to the agreed project scope — including significant changes to room count, project type, or material selections — will be discussed with you before additional work proceeds. We aim for this process to feel considered and transparent, not transactional.
6. Client Responsibilities
To allow us to deliver your project well, we ask that you:
- Provide accurate and complete information about your space, requirements, and any existing constraints
- Review and respond to draft materials within the timeframes we agree upon
- Grant us reasonable access to the property where site visits are part of the engagement
- Engage any third-party contractors or suppliers in accordance with relevant regulations
- Ensure all necessary permits and approvals are in place before renovation work commences
Significant delays caused by a client's unavailability or late provision of required information may affect the agreed project timeline. We will flag this with you as early as possible.
7. Intellectual Property
All design concepts, drawings, 3D renderings, material boards, and documentation produced by Somn Studio remain our intellectual property until full payment has been received for the engagement.
Upon receipt of full payment, you receive a licence to use the delivered materials for the specific project for which they were created. You may not reproduce, adapt, or share our design work for use in other projects or for commercial purposes without our written permission.
We reserve the right to use images of completed projects for our portfolio, website, and professional publications, unless you have specifically requested otherwise in writing at the time of engagement.
8. Cancellation and Withdrawal
You may withdraw from an engagement at any time by notifying us in writing. Where work has commenced, fees for completed stages and reasonable costs incurred up to the point of withdrawal will remain payable.
If you withdraw after the Introductory Design Dialogue session has taken place, the full session fee is non-refundable. For longer engagements, fees will be calculated on a pro-rata basis relative to the work completed at the time of withdrawal.
Somn Studio reserves the right to withdraw from an engagement where it becomes impractical to continue — for instance, in the event of sustained non-communication, non-payment, or requests that conflict with our professional standards. In such cases, we will provide reasonable notice and settle any outstanding financial matters fairly.
9. Limitation of Liability
Our services involve design recommendations and coordination support. We are not responsible for the actions, workmanship, or conduct of third-party contractors or suppliers you engage independently.
To the extent permitted by Malaysian law, our total liability to you in connection with any engagement shall not exceed the total fees paid by you for that engagement. We are not liable for indirect, consequential, or incidental losses.
Nothing in these Terms limits our liability for fraud, death, or personal injury caused by negligence.
10. Confidentiality
We treat all client information — including personal preferences, property details, and budget — with discretion. We will not disclose confidential project information to third parties except where necessary to deliver the agreed services (e.g., sharing specifications with a supplier) or where required by law.
We ask that clients treat our design materials, pricing, and working methods with corresponding discretion. Our detailed design documents are not to be shared with other design practitioners for the purpose of replication.
11. Governing Law
These Terms are governed by the laws of Malaysia. Any disputes arising from or relating to these Terms or any service engagement shall be subject to the exclusive jurisdiction of the courts of Malaysia.
We encourage any concerns to be raised with us directly in the first instance. Most matters can be resolved through straightforward conversation, and we are committed to handling disagreements fairly and professionally.
12. Changes to These Terms
We may update these Terms from time to time to reflect changes in our services or applicable law. The most recent version will always be available on our website. For active engagements, any material changes will be communicated to you directly. Continued use of our website or services after an update constitutes acceptance of the revised Terms.
